INDONESIAN HAS THE REGULATION ON THE SCIENCE AND TECHNOLOGY ZONE |
Considering in order to
facilitate the growth and development of industries, especially innovative
small-and-medium-scale industries, the government considers it necessary to
provide services to industries within a specially prepared area, and a vehicle
that will facilitate the flow of invention into innovation to increase
productivity and competitiveness.
On the basis of these
considerations, on 22 November 2017, President Joko Widodo (Jokowi) has signed
the Presidential Regulation (Perpres) Number 106 Year 2017 on Science and
Technology Area.
"Science and
Technology Park, hereinafter abbreviated as KST is a professionally managed
vehicle to develop and promote sustainable economic growth through the
development, application of science and technology, and the growth of
technology-based novice companies," said Article 1 paragraph (1) of this
Presidential Regulation.
The objectives of
development and development of KST, according to this Presidential Regulation,
are: a. realization of synergy of function and role of academia, business, and
government; b. the availability of a conducive environment for ongoing
research, development, and technology business activities; c. grows and
develops Technology-Based Beginning Companies; d. the realization of a new
company that is the result of Spin Off, and e. availability of technology
services to support industry competitiveness.
According to this
Presidential Regulation, in performing the functions referred to in Article 4,
KST provides services: a. technical; b. technology development; c. Incubation
of technology business; and D. support services.
"KST can be: a.
integrated zone; or b. connected zone, "reads Article 8 of this Perpres.
The integrated zone
referred to is an integral area in providing facilities and infrastructure for
the development and growth of the economy through the utilization of science
and technology.
While the Zone connected as
intended is a region located in several separate but interconnected locations
in providing facilities and infrastructure for the development and growth of
the economy through the utilization of science and technology.
The organizer of KST,
according to this Presidential Regulation, consists of: a. Central Government
and / or regional government; b. College; and c. Society (including: a)
Business Entity, b) union, or c) Association.
"The organizer of the
KST as intended may hold the KST individually or jointly," read Article 10
paragraph (3) of this Presidential Regulation.
This Presidential
Regulation affirms that the terms of establishment of KST shall at least have:
a. sources of technology; b. human Resources; c. sources of funding; d. land /
place; and e. areas of focus to be developed.
"Further provisions
concerning the requirements for establishment of KST shall be regulated by a
Ministerial Regulation (which governs the affairs of government in the field of
science and technology, red)," read Article 11 paragraph (2) of this
Regulation.
Affirmed in this
Presidential Regulation, KST must have the means and infrastructure to: a.
technology development; b. Incubation of technology business; and c. technology
services
Technological facilities
and infrastructures referred to, according to this Perpres, may be design
centers, prototype centers, space for legal consultations and intellectual
property, or other forms of service that support technology development.
Facilities and
infrastructure The technology business incubation referred to may be a joint
office, business space, facilitation of pilot production, business service
center, training room, access to financing, or other forms of service that
support technology business incubation.
While technological
facilities and infrastructures as mentioned can be in the form of training
room, production test facility, showroom, data room and information /
documentation, test laboratory, network of experts / experts, or other forms of
service supporting technology services.
"The Central
Government and / or the Local Governments provide, manage and develop basic
facilities and infrastructure of KST in particular access roads, roads,
drainage and waste management, clean water infrastructure, electricity and
information and communication technology, and access to transportation, or
goods to KST in accordance with the duties and functions based on the
provisions of legislation, "read Article 16 of this Regulation.
Recipient of the Service
According to this
Presidential Regulation, the recipient of the KST service may be: a. tenant
KST; and b. non tenant KST. Tenant KST as intended is the party who gets the
services of KST within a certain time according to the cooperation agreement.
While non tenant KST is a party who gets the services of KST without
cooperation agreement.
The quality assurance of
management is done through: a. registration; b. assessment; c. recommendation;
d. ranking; e. coaching; and f. Supervision.
"Registration of KST
as intended by the Minister," reads Article 25 paragraph (2) of this
Presidential Decree.
To ensure the quality of
KST implementation, according to this Presidential Regulation, the Minister
shall supervise.
"Supervision as
referred to cover administrative, technical, and performance, carried out in
accordance with the provisions of legislation," read Article 32 paragraph
(2.3) of this Presidential Regulation.
The Presidential Regulation
also mentioned that the Minister evaluates to assess the Maturity of KST, which
is based on indicators of growth and development of KST performance. Further
provisions concerning the evaluation, indicators and Maturity of the KST shall
be governed by a Ministerial Regulation.
As for the funding for the
implementation of KST, according to this Presidential Regulation, sourced from
the State Budget, Regional Budget, and other legal sources in accordance with
the provisions of legislation.
"This Presidential
Regulation shall come into force on the date of promulgation," read
Article 38 of Presidential Regulation No. 106 of 2017, which has been enacted
by the Minister of Justice and Human Rights Yasonna H. Laoly on November 22,
2017.
